1. Acceptance of Terms

By downloading, accessing, or using BiyaLink, a product of DenoSys LTD, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Eligibility

To use BiyaLink, you must:

• Be at least 18 years of age
• Be a resident of Nigeria
• Have a valid Nigerian phone number
• Complete our KYC verification process
• Have the legal capacity to enter into a binding agreement

3. Account Registration

You are responsible for maintaining the confidentiality of your account credentials, including your PIN and any biometric data used for authentication. You agree to notify us immediately of any unauthorized use of your account.

4. Services

BiyaLink provides the following services:

• Wallet: Store and manage funds in NGN and USD
• Airtime & Data: Purchase airtime and data bundles for Nigerian networks
• Bill Payments: Pay utility bills including electricity, cable TV, and internet
• Virtual Cards: Create and manage virtual Naira and Dollar cards
• Currency Swap: Convert between NGN and USD at prevailing rates

5. Fees and Charges

Certain services may be subject to fees, which will be disclosed before you complete a transaction. Currency exchange rates are determined at the time of transaction and may fluctuate. We reserve the right to modify our fee structure with prior notice.

6. Prohibited Activities

You agree not to:

• Use the service for any illegal or fraudulent purpose
• Violate any applicable laws or regulations
• Attempt to gain unauthorized access to our systems
• Use the service for money laundering or terrorist financing
• Create multiple accounts or provide false information
• Interfere with or disrupt the service

7. Transaction Limits

Transaction limits may apply based on your verification level and regulatory requirements. These limits are subject to change and will be displayed in the app.

8. Liability

BiyaLink is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability shall not exceed the amount of fees paid by you in the preceding 12 months.

9. Account Suspension

We reserve the right to suspend or terminate your account if we suspect fraudulent activity, violation of these terms, or as required by law. You may also close your account at any time by contacting support.

10. Dispute Resolution

Any disputes arising from these terms shall be resolved through good faith negotiation. If unresolved, disputes shall be submitted to arbitration in Lagos, Nigeria, in accordance with Nigerian law.

11. Changes to Terms

We may update these terms from time to time. Continued use of BiyaLink after changes constitutes acceptance of the modified terms. We will notify you of significant changes via email or in-app notification.
